As you may be aware, Blair Nimmo of KPMG LLP was appointed as Provisional Liquidator of the above Company on 17 October 2008. I can now confirm that this appointment has been recalled, and subsequently Stephen Cork and Anthony Spicer of Smith & Williamson were appointed as Joint Interim Liquidators of the Company by the Court of Session on 11 November 2008.

 

The Interim Liquidators are currently in the process of obtaining and reviewing the Provisional Liquidator’s files and the Company records. An initial circular was sent to all known creditors on 28 November 2008, containing details of an upcoming meeting of creditors on 16 December 2008. This circular is attached to this page for your reference.

 

We have been in contact with the Financial Services Authority (FSA) who have advised that the FSA Register has been amended to reflect the fact that the Company is no longer conducting investment business. The Interim Liquidators are liaising with the Financial Services Compensation Scheme (FSCS) to determine the FSCS's potential role in handling claims. We have been advised by the FSCS that there is no need for you to notify them of your claim at this point in time. However, if it subsequently appears likely that the FSCS will be able to deal with claims against the Company, the FSCS will contact investors who have made a claim in the liquidation.
